دور مقصد '' حفظ المال '' في ترسيخ الأمان الأُسرَّي- مال الزوجين المشترك أنموذجًا

مُلخَّص البحث:
 عُنيت الشَّريعة فِي كُلِّ أحْكامهَا بِتحْصِيل مقاصدهَا وجلْب مصالحهَا، ومقاصد الشَّريعة مِن اَلخُلق خَمسَة أَشيَاء هِي حِفْظ: دِينهم، نُفوسهم، عُقولهم، نَسلُهم، وأمْوالهم، وَأَناطَت كُل وَاحِدة مِنهَا بِجمْلة مِن الأحْكام تَحَفظهَا مِن جَانِب اَلوُجود كمَا تَحَفظهَا مِن جَانِب العدم؛ وقد حَظيَت الأحْكام المتعلِّقة بِالْمَال نصيبًا وافرًا مِن تِلْك الأحْكام اَلتِي شَرعَت لَه بِاعْتباره قِوَام الأدْيان والْأبْدان.
    فالمَال وَسِيلَة المعَاش لِلرَّجل والْمرْأة تحْقيقًا لِعمارة الأرْض وَفْق مُبتَغَى الشَّارع ، وَخَاصَّة فِي رِحَاب النَّوَاة اَلأُولى واللَّبنة اَلأُم اَلأُسرة الحاضنة ؛ فأصْبح لِزامًا تَأطِير الواقع المعاصر اَلذِي تَعرِفه اَلأُسرة المسْلمة جَرَّاء وُلُوج المرْأة لِلْعمل وإقْبالهَا اَلشدِيد على التَّعْليم ومشاركتهَا فِي تَنمِية المجْتمع والْأسْرة بِمبادئ وَأسَّس شَرعِية تَضبُط العلاقة الماليَّة بَيْن الأزْواج ، وتطْرح حُلولا بَدِيلَة تَلاءَم مُسْتجدَّات الوضْع الرَّاهن ، لِتصحِّح وَضْع المرْأة وتنقُّلهَا مِن وَضْع التَّبعيَّة والسُّلْطة ، وَمِن مَبدَأ الطَّاعة مُقَابِل الإنْفاق إِلى وَضْع التَّكامل والتَّشارك فِي الرِّعاية والْمسْؤوليَّة الأسريَّة ، وتحْقيقًا لِلْعدْل بَيْن الأزْواج ، وحفْظًا لِأمان الرَّابط اَلأُسري ، وتعْميقًا لِأواصر الميثاق اَلغلِيظ.
   وعليْه تَجلَّت أَهَميَّة البحْث بِعمْق مُشكلتِه فِي بَيَان أثر حِفْظ مَقصِد اَلْمال خَاصَّة فِي رَسْم المنْهج لِلْعلاقة الماليَّة المشْتركة بَيْن الزَّوْجيْنِ ، ومَا يَشُوب هَذِه العلاقة مِن إِشْكاليَّات تَنعَكِس سلْبًا على اَلأُسرة مِن اِضطِراب مُشكَّل وتفكُّك مُرْعِب يُؤدِّيَان إِلى فِقْدَان الأمَان اَلأُسري ، والدُّخول فِي دَوَّامة الصِّرَاع بَيْن الزَّوْجيْنِ لِإثْبَات الأكْثر إِنْفاقًا والْأقْوى تحكُّمًا ، بِاتِّبَاع مَنهَجِي ( اَلوصْفِي والتَّحْليليِّ) فِي عَرْض جُزْئيَّات الإشْكاليَّة ، فانْتَظم البحْث بِمقدِّمة وَأَربعَة مَباحِث وَخاتِمة بِأَهم النَّتائج وأبْرز التَّوْصيات .

The role of the purpose of "save money" in establishing the safety of the family-common couple money model

Abstract:
   In all its rulings, the Sharia is concerned with achieving its aims and bringing its interests, and the purposes of the Sharia from creation are five things that are preservation: their religion, their souls, their minds, their offspring, and their money, and each one of them is assigned to a set of rulings that it preserves from the side of existence as it preserves them from the side of nothingness. The rulings related to money have received a large share of those rulings that were legalized for him as the foundation of religions and bodies.
    Money is a means of subsistence for men and women in order to achieve the architecture of the land according to the aspirations of Allah, especially in the vicinity of the first nucleus and the mother brick, the foster family It has become imperative to frame the contemporary reality that the Muslim family knows as a result of women's access to work and their strong interest in education and their participation in the development of society and the family with Sharia principles and foundations that control the financial relationship between husbands and offer alternative solutions that are compatible with the developments of the current situation, to correct the status of women and move them from a position of dependency and power, and from the principle of Obedience in exchange for spending to the status of integration and sharing of care and family responsibility, and to achieve justice between spouses, to preserve the permanence of the family bond, and to deepen the bonds of the harsh covenant.
   Accordingly, the importance of researching in depth his problem was evident in explaining the effect of the maqsad of saving money in drawing the curriculum for the joint financial relationship between the spouses, and the problems that mar this relationship negatively reflected on the family in terms of problematic disorder and terrifying disintegration, and entering into the spiral of conflict between the spouses to prove the strongest and the spending, following a descriptive method And analytical in presenting the parts of the problem, the research was with an introduction, four discussions, and ending with the most important results and the most prominent recommendations.
