الملخص:
فهذا بحث في بيان حكم التخدير عند القصاص، وهي مسألة من النوازل الفقهية، ويمكن القول إنَّ محل البحث في هذه النازلة من كلام المتقدمين يُنظر فيه إلى تعليلات الفقهاء والغرض من القصاص، وبعض المسائل التي ألمحوا فيها إلى قصد الألم، ومع عدم تصريح جملة الفقهاء بالألم، إلا أن بعض الفقهاء نصَّ على الألم وجعله مقصوداً، إلا أنَّه لا يكفي لتأصيل المسألة عند المذاهب، فالغرض من البحث تأصيل المسألة، وهذا التأصيل إنما يحصل باجتماع أمرينتحرير قصد الألم في القصاص، وما يمكن ذكره من نصوص الفقهاء، وما يكون للمجني عليه لو أراد بدلاً للألم فهل يكون له ذلك؟ وما الذي يكون له؟ وهل ثمَّ موانع تمنع من تطبيق ذلك؟ وهذا التأصيل يمكِّن الناظر من الوصول إلى غلبة الظن بحكم هذه النازلة، والله أرجو التوفيق والإعانة.

Abstract:
This is a research in explaining the ruling on anesthesia when retaliation, and it is an issue of jurisprudential issues, and it can be said that the subject of research in this issue from the words of the predecessors is to look at the justifications of the jurists and the purpose of retaliation, and some issues in which they alluded to the intention of pain, and with the lack of a statement by the majority of jurists about pain However, some jurists stipulated pain and made it intentional, but it is not sufficient to root the issue according to the schools. He wanted a substitute for pain, so does he have that? And what would he have? Are there any barriers that prevent the application of this? This rooting enables the beholder to arrive at the predominance of conjecture with the ruling of this catastrophe. By God, I hope for success and assistance.
