ملخص:
  تُعدّ نظرية الوصم الاجتماعي من النظريات التفسيرية نسبياً-في علم الاجتماع الجنائي ، إذ  تحاول تفسير الانحراف والعود له، ورغم ما أضافته نظرية الوصم الاجتماعي من إسهامات علمية لا يمكن انكارها - في تفسير بعض ظواهر الانحراف والعود له -إلا أن الكثير من النتائج التي تم بناؤها على تلك النظرية لا يمكن التسليم بها ، فالنظرية تفترض أن التصنيف أو الوصم للشخص هو فقط الذي يؤدي لجعله منحرفًا دون مراعاة الأسباب الأخرى التي تدفع الأشخاص للانحراف ،مثل عوامل التنشئة الاجتماعية،  وبالتالي وقفت النظرية عاجزة عن تفسير الانتهاكات الاجتماعية الخطيرة ، والتي قد تحدث من قبل أشخاص لم يسبق لهم ارتكاب جرائم سابقة ،ولم يتعرضوا للوصم الاجتماعي.
 أمّا منهج الشريعة الإسلامية فقد جاء أحكم وأدق في هذا الجانب ،حيث أقرت الشريعة  بأن للوصم أثر في العود للجريمة، ولكنها لم تغفل عن الأسباب الأخرى التي تدفع إلى العود بمعزل عن الوصم.

Abstract:
   The theory of social stigma is one of the relatively explanatory theories - in criminal sociology, as it tries to explain deviance and return to it, and despite the undeniable scientific contributions added by the social stigma theory - in explaining some phenomena of deviance and return to it, but many of the results that have been built According to this theory, it cannot be taken for granted, as the theory assumes that classification or stigmatization of a person is only what leads to making him deviant without taking into account other reasons that push people to deviate such as factors of socialization, and therefore the theory stood unable to explain the serious social violations that may occur by people They have never committed a previous crime, and they have not been subjected to social stigma.
  As for the approach of Islamic law, it was wiser and more accurate in this aspect, as the law recognized that stigmatization has an effect on recidivism, but it did not overlook the other reasons that lead to recidivism in isolationfrom stigmatization.
