ملخص البحث:
يحدث الطلاق غالبًا بعد خلافات زوجية, والإنسان عند الخصومة قد يشتط فيجافي العدالة في سلوكه؛ فقد تولَّى الله -عزّ وجل- بيان الكثير من أحكام إنهاء العلاقة بين الزوجين في كتابه العزيز، وقد عُنِيت كتب الفقه بأحكام الطلاق فأفردت له كتابًا، وقسَّمته أبوابًا، ومن أبوابه وفروعه المهمةما يتعلّق بصيغ الطلاق الصريح، وحيث إن هذه الصيغ قد استجدَّ فيها وفي أحكامها مسائل مستجدة،ومن هنا كان اهتمام هذا البحث بهذا الموضوع من خلال التساؤلات الآتية:

ما هي ألفاظ الطلاق الصريح؟
ما أثر الطلاق باللفظ الصريح؟
ما حكم الشرع بالصيغ المستجدة للطلاق باللفظ الصريح؟

وذلك من خلال دراسة الموضوع دراسة فقهية مقارنة، مع إعطاء تصوُّر واضح عن مفهوم الطلاق والصيغة، وتحليل المسائل المتعلّقة بالصيغ المستجدِّة للطلاق باللفظ الصريح تحليلًا دقيقًا، والحكم عليها من خلال قرارات مجاميع الفقه، والآراء الفردية من الفقهاء المعاصرين، ودراسة أدلّة كل رأي؛ بهدف التوصّل إلى الرأي المختار منها.

Explicit Verbal Divorce, Its Effect, And Its Emerging Formulas
(A Comparative Jurisprudential Study)

Abstract:
 Divorce often takes place after marital disputes, and when a person is in conflict, he may go to extremes and avoid justice in his behavior. God Almighty has entrusted the explanation in His Holy Book of many provisions for ending the relationship between the spouses. The books of jurisprudence have taken care of the provisions of divorce and singled out a book for it and divided it into chapters; and its important chapters and branchesinclude explicit divorce formulas.And because these formulas and their provisions have developed new issues, this research is interested in this topic through the following questions:

What are the words of explicit divorce?
What is the effect of divorce with explicit word?
What is the Shari'a ruling on the new formulas for explicit verbal divorce?

That was done by studying the topic in a comparative jurisprudential study, giving a clear perception of the concept of divorce and the formula, providing an accurate analysis to the issues related to the emerging formulas of divorce by explicit word, judging them through the decisions of the jurisprudence groups and the individual opinions of contemporary jurists, and studying the evidence of each opinion in order to reach the opinion chosen from them.
