ملخص البحث:
يهدف هذا البحث إلى رصد معالم التشريع القرآني في آيات نداء الله الذين آمنوا، وذلك بالوقوف على ما تضمنته من أسس ومبادئ وكليات ومؤيدات تشريعية، وما تضمنته – أيضا - من تشريعات جزئية. يعتمد البحث في الأساس على المنهج الوصفي التحليلي؛ حيث يحلل آيات نداء الله الذين آمنوا للوقوف على ما تضمنته من معالم التشريع القرآني على النحو المبين. النتائج والتوصيات: يقوم التشريع القرآني في آيات نداء الله الذين آمنوا على ثلاثة أسس تشريعية: إيمانية وأخلاقية وشعائرية، في سبيل رصد المبادئ والكليات التشريعية وقفت الدراسة على أكثر من عشرين مبدأ كليا، منها: التدرج في التشريع، وعدم رجعية التشريع، والسكوت التشريعي عفو، وبناء الأحكام على التيسير ورفع الحرج، والضرورات تبيح المحظورات... إلخ، أكدت الآيات على وجوب التزام الذين آمنوا بالعدل في الحكم والقضاء والشهادة، وحذرت من عوارض العدل فيها جميعا، واشتملت الآيات على أصول تشريعات الإثبات والتوثيق عن طريق الكتابة والشهادة والرهن، وغير ذلك من قواعد العدالة، تضمنت الآيات أصول التشريعات المتعلقة بالمجتمع والدولة في الإسلام، القائمين على أسس الأخوة الإيمانية والتعاون على البر والتقوى لا على الإثم والعدوان والاعتصام بحبل الله القويم وتحمل المسئولية عن حماية القيم الإسلامية والأخلاق الفاضلة من خلال الأمر بالمعروف والنهي عن المنكر، كما تضمنت القواعد الحاكمة للعلاقات الخارجية بين المسلمين وغيرهم في حالتي الحرب والسلم، تضمنت آيات النداء العديد من التشريعات الجزئية المتعلقة بالحلال والحرام وأحكام الأسرة والنساء والأقارب والمعاملات المالية والجرائم وعقوباتها... وغيرها، جاءت التشريعات القرآنية في آيات النداء مصحوبة بالمؤيدات التشريعية حملا للمكلفين على الاستجابة لها وتنفيذها، وقد شملت التأييد بذكر أسماء الله - تعالى - وصفاته، والترغيب أو الترهيب بجزاء دنيوي أو أخروي، وذكر القدوة والأسوة وضرب الأمثال. وفي الختام: توصي الدراسة بإجراء مزيد من الأبحاث لبيان منهج التشريع القرآني ورد الشبهات الواردة حوله من قبل المستشرقين وغيرهم.

Features of Qur’anic legislation in the Ayas of Allah Almighty’s call to believers

Abstract:
This research aims to monitor the features of Qur’anic legislation in Ayas of Allah’s call to believers, with examining the foundations, principles, universals, and legislative supports they contain, as well as the partial legislation they contain. The research relies mainly on the descriptive and analytical method. It analyzes Ayas of Allah’s call to believers to determine what they contain of the features of Qur’anic legislation as stated.
Results and recommendations: Quranic legislation in Ayas of Allah’s call to believers is based on three legislative foundations: faith, moral, and third, In order to monitor the legislative colleges and principles, the study focused on more than twenty general principles, including: gradualism in legislation, non-retroactivity of legislation, legislative silence is pardon, building judgments on facilitation and lifting embarrassment, and necessities permit prohibitions...etc, The Ayas emphasized the obligation of those who believe in justice to adhere to judgment, judgment, and testimony, and warned against the obstacles to justice in all of them. The Ayas included the principles of the legislation of proof and documentation through writing, testimony, mortgage, and other rules of justice, The Ayas included the principles of legislation related to society and the state in Islam, based on the foundations of brotherhood of faith and cooperation on righteousness and piety, not on sin and aggression, and holding fast to the upright rope of God and bearing responsibility for protecting Islamic values and virtuous morals through enjoining good and forbidding evil. They also included the governing rules. For external relations between Muslims and others in in the states of war and peace, The Ayas of the call included many partial legislations related to what is permissible and what is forbidden, the provisions of the family, women and relatives, financial transactions, crimes and their punishments... and others, The Qur’anic legislation in the Ayas of the call was accompanied by legislative support to encourage those responsible to respond to it and implement it. It included support by mentioning the names and attributes of God Almighty, enticing or intimidating with a worldly or hereafter reward, mentioning role models and examples, and setting examples.In conclusion: The study recommends conducting further research to clarify the approach to Quranic legislation and refute the suspicions raised about it by orientalists and others.
