 هذا البحث: (ولاية القضاء في الفقه الإسلامي والنظام السعودي) تناول أبرز أحكام ولاية القضاء في الفقه والنظام، ومدى ملاءمة تطور الأنظمة التشريعية بالمقاصد الشرعية.تحدثت في بداية البحث عن تعريف القضاء ومشروعيته، ثم تناولت خمسة عشر موضوعًا مجموعة في ثلاثة مباحث متعلقة بمبادئ القضاء، وأهلية القاضي في الفقه والنظام، وحجية حكم القاضي، وأحكام عزله واعتزاله. وذلك بعد استقراء المراجع الفقهية والاستدلال بالأدلة الشرعية، والقواعد الفقهية، مع ذكر وبيان الأنظمة والنصوص القانونية المتعلقة بالموضوع. وقد استندت في ذلك على: نظام القضاء الصادر بالمرسوم الملكي رقم: م/ 78 بتاريخ: 19/ 9/ 1428هـ، ونظام المرافعات الشرعية الصادر بالمرسوم الملكي رقم: م/ 1 بتاريخ: 22/1/ 1435هـ، ونظام الهيئة العامة للولاية على أموال القاصرين ومن في حكمهم الصادر بالمرسوم الملكي: م/ 17، بتاريخ: 13/ 3/ 1427هـ. وقد انتهت الدراسة بذكر أبرز النتائج والتوصيات منها،  الولاية: سلطة شرعية تمكن صاحبها من مباشرة العقود وترتب آثارها عليها دون توقف على إجازة أحد، القضاء: تبيين الحكم الشرعي والإلزام به وفصل الحكومات، مشروعية القضاء بالكتاب والسنة والإجماع، والأصل أن القضاء من فروض الكفاية، إلا أنه قد تعتريه الأحكام الخمسة، القاضي لا يأخذ شرعيته إلا بتعيين من ولى الأمر باتفاق الفقهاء، والعمل في النظام السعودي جاء على أساس هذا المبدأ، جرت أحكام الشريعة الإسلامية على أنه يقدم في كل ولاية من هو أقوم بمصالحها على من هو دونه، ومن ذلك ولاية القضاء.

The mandate of the judiciary in Islamic jurisprudence and the Saudi system

Abstract:
This research: (The jurisdiction of the judiciary in Islamic jurisprudence and the Saudi system) excels in the jurisdiction of the judiciary in jurisprudence and the system, and the extent of electronic court books with the purposes of Sharia.At the beginning of the research, I spoke about the definition of the judiciary and its legitimacy, then I discussed fifteen topics grouped into three sections related to the principles of the judiciary, the competence of the judge in jurisprudence and law, the validity of the judge’s ruling, and the rulings on his removal. And his retirement. This is after extrapolating jurisprudential references and inferring Sharia evidence and jurisprudential rules, while mentioning and clarifying the legal systems and texts related to the subject. It was based on: the judicial system issued by decree.Royal No.: M/78 dated: 9/19/1428 AH, and the system of legal proceedings issued by Royal Decree No.: M/1 dated: 1/22/1435 AH, and the system of the General Authority for the Guardianship of the Funds of Minors and Those in Their Status issued by Royal Decree: M/17 Dated: 3/13/1427 AH.The study ended by mentioning the most important results and recommendations, including: guardianship: a legitimate authority that enables its owner to carry out contracts and arrange their effects on them without relying on anyone’s permission, the judiciary: clarifying the legitimate ruling and binding it and separating governments, the legitimacy of the judiciary according to the Qur’an, the Sunnah and consensus, and the principle is that the judiciary is one of the duties of sufficiency. However, it may suffer from the five rulings. The judge does not take his legitimacy except by appointing the person in charge with the agreement of the jurists, and work in the Saudi system came on the basis of this principle. The provisions of the Islamic Sharia were based on the fact that in every state, the one who has the most interests in its interests is given precedence over the one who is below him, and this includes Judicial jurisdiction.
