النوازل الفقهيــــــــة للمــــــــــــال العــــــــــــام

ملخص البحث :
     فإن الله عز وجل جعل هذه الشريعة محيطة بأفعال العباد، صالحة لكل زمان ومكان، مشتملة على قواعد كلية، ومقاصد شرعية، يستنبط من خلالها أهلُ العلم حكماً لكل مسالة نازلة ومستجدة. وقد اتسعت في هذا الزمان معارفُ الإنسان واكتشافاته ومخترعاته في كافة المجالات؛ فكثرت النوازل المستجدة. ومن أهم القضايا التي تستحق أن توجه إليها العناية في البحث: المال العام وما يتعلق به من النوازل الفقهية. يهدف البحث إلي معالجة موضوعًا مهمًا في واقع الحياة، وما من أمة إلا وتحاول أن ترفع من مستواها الاقتصادي والاداري والوظيفي؛ لتحقق مكانا مرموقا بين الشعوب، وهو المال العام ونوازله، توعية الناس بما ينبغي عليهم معرفتُه من الأحكام الشرعية المتعلقة بنوازل المال العام. وأكدتْ الدراسة على أن المحافظة على المال بصفة عامة والمال العام بصفة خاصة وتنميته واستثماره ضرورة من ضروريات الإنسان ، لأداء وظيفته الاستخلافية في عمارة الأرض والعيش بما أحله الله، لا تجب الزكاة في المال العام ؛ لكونه غير مملوك ملكا تاما، اتفق الفقهاء على أنه لا يجوز لولي الأمر أن ينفق شيئا من المال العام على وجه الهبة، نص الفقهاء على منع ولي الأمر من التصرف في المال العام بهواه، بحيث لا يراعي في إنفاقه العدل والاستحقاق.

ABSTRACT:
God Almighty made this law encompassing the actions of His servants, valid for every time and place, and containing comprehensive rules and legal objectives, through which the people of knowledge derive a ruling for every current and emerging issue. In this time, human knowledge, discoveries and inventions have expanded in all fields. New calamities increased. Among the most important issues that deserve attention in research: public money and the issues of jurisprudence related to it. The research aims to address an important topic in real life, and there is no nation that does not try to raise its economic, administrative, and functional level. To achieve a prominent place among the people, which is public money and its calamities, educating people about what they should know of the legal rulings related to the calamities of public money. The study emphasized that preserving, developing, and investing money in general and public money in particular is one of the human necessities, in order to perform his successor function in rebuilding the earth and living according to what God has permitted. Zakat is not obligatory on public money. Because it is not fully owned, the jurists agreed that it is not permissible for the guardian to spend any of the public money as a gift. The jurists stipulated that the guardian should be prevented from disposing of the public money according to his whim, such that he does not take into account justice and merit in his spending.
