ملخص البحث:
هذا البحث يتناول عوارض الأهلية عند الأصوليين، سواء أكان للعبد فيها اختيار، وهي ما يسمى بالعوارض المكتسبة، أو لم يكن له فيها اختيار، وهي ما تسمى بالعوارض السماوية، ويتناول كذلك بيان أثر تلك العوارض في الأحكام الواردة في نظام المعاملات المدنية السعودي، وتأثيرها في أحكام معاملات المكلف مع الآخرين. وقد كشف هذا البحث عن أثر عوارض الأهلية في كثير من الأحكام الواردة في النظام، وعن استناد مواد هذا النظام إلى التراث الفقهي الإسلامي. ثم إن هناك جملة من النتائج ظهرت في هذا البحث أوجز بعضها في النقاط الآتية: الأهلية تنقسم عند الأصوليين إلى أهلية وجوب وأهلية أداء، عوارض الأهلية هي: الخصال التي لها تأثير في الأحكام المتعلقة بالمكلف، إما بالتغيير أو بالإعدام، عوارض الأهلية إما أن يكون ليس للعبد فيها اختيار، فهذه هي العوارض السماوية، وإما أن يكون له فيها اختيار فهذه هي العوارض المكتسبة.

 Abstract:
This research studies the obstacles of eligibility with fundamentalists, whether voluntary (acquired obstacles) or compulsory (divine obstacles).  It also delves into understanding the effect of these obstacles on provisions contained in Saudi Civil Transactions Law, and on transactions of the eligible person with others in particular.This research clarifies the effects of eligibility obstacles on many provisions contained in law and the reliance of this law on the Islamic jurisprudential heritage. Then there is a number of results that appeared in this research, some of which were summarized in the following points: Capacity is divided according to fundamentalists into eligibility for obligation and capacity for performance. The symptoms of eligibility are: the characteristics that have an impact on the rulings related to the taxpayer, either by change or death. The symptoms of eligibility are either not The servant has a choice in it, and these are the heavenly accidents, or he has a choice in it, and these are the acquired accidents.
