ملخص:
هذه الدّراسة بعنوان: "المال الرقمي، ماهيته، أحكامه، وآثاره- دراسة فقهية" وتكمن إشكاليتها في الأشياء الرقميّة هل تتوفر فيها عناصر الماليّة، فتعدّ من جملة الأموال، ويمكن تملكها والتصرف فيها أو لا؟ وترجع أهمية هذا الموضوع إلى تناوله لموضوع مهم يتعلق بأمور مستجدّة لم تكن موجودة من قبل، فهي بحاجة لدراستها من أجل إنزال الأحكام الشرعيّة عليها حتى يتبين حكم ماليتها من عدمه إلى جانب بيان الآثار الناتجة عن ذلك من إخراج الزكاة عنها، وإمكان إجراء التصرفات الماليّة عليها، وتوريثها من عدمه؛ وذلك نظراً لما تمثله من قيمة مالية كبيرة، وقد تناول الفقهاء قديماً أحكام المال وبيان حقيقته وعناصر الماليّة فيه، وأنواع الملكيّة، وقد جاءت هذه الدّراسة كمحاولة لوضع تصور شامل للأشياء الرقميّة، بهدف إنزال الأحكام الشرعيّة عليها؛ لبيان ثبوت الماليّة فيها من عدمه، وأنواع الملكيّة التي تقع عليها، والأثر المترتب على ذلك من بيان خلال أقوال فقهاء المذاهب الفقهية المعتمدة في المسائل محل الدّراسة باستخدام المناهج الاستقرائي، والتحليلي، والوصفي، وقد خلصت هذه الدّراسة إلى بعض النتائج المهمة منها: أن المال ما تميل إليه الطباع ويتموّله الناس عادة كلهم أو بعضهم، وفيه منفعة مقصودة مباحة شرعاً، كان موجوداً وحيز بالفعل، أو لم يحز ولكن يمكن ذلك، وانطباق عناصر الماليّة على الأشياء الرقميّة مع اختلاف الملكيّة الواقعة عليها كالأموال الماديّة المحسوسة، بين ملكيّة العين والمنفعة، أو ملكيّة أحدهما فقط العين أو المنفعة، أو تملك حق الانتفاع فقط دون المنفعة، وإمكانية إجراء التصرفات المالية فيها، وتوارثها.

Abstract:
this study is entitled: "digital money, what it is, its provisions, and its effects- A fiqhi study " and its problem lies in digital things, do they have financial elements, so they are counted among the funds, and can they be owned and disposed of or not?" The importance of this topic is due to the fact that it deals with an important topic related to new things that did not exist before, they need to be studied in order to pass down Sharia judgments on them in order to determine whether their finances are judged or not, as well as the statement of the effects resulting from the withdrawal of zakat from them, and the possibility of financial actions This study has concluded some important results, including: whether or not the finance is proven in them, the types of ownership that fall on them, and the impact that follows from a statement through the statements of the jurists of the Fiqh doctrines adopted in the issues under study using inductive, analytical, and descriptive methods, and this study has concluded some important results, including: The elements of Finance apply to digital objects with different ownership located on them, such as tangible physical money, between the ownership of the eye and the benefit, or the ownership of only one of the eyes or the benefit, or the ownership of only one of the eyes or the benefit, or the possession of the right of use only without the benefit, the possibility of conducting financial transactions in them, and their inheritance.
