العدالة الناجزة للتقاضي ... اقتراحات عملية

الملخص:
    يعرض البحث لنظام متكامل قد يُسهم في تطوير القضاء بشكل فعال، ويكون التقاضي فيه الكترونياً وعلى درجة واحدة يتألف من قضاة مُتخصصين بالإضافة إلى قاضي تحضير، حيث إن هذا النظام يهدف بشكل أساسي لتسهيل التقاضي، وتحقيق العدالة الناجزة من خلال السرعة باستيفاء الحق، وذلك لتفادي البطء في التقاضي ، غير أن هذا النظام له فوائد اقتصادية بحيث يجذب الاستثمار، ويُعزز ثقة الأفراد باللجوء إلى القضاء لما يُشكل هذا النظام ثقة أكبر وسرعة، لذا تقترح على المشرع الكويتي أن يواكب التطورات عن طريق وضع قانون مُتكامل يتبنى هذا النظام.
وبناءً على ما تقدم يطرح الباحث عدة تساؤلات للتوصل إلى حلول عملية لها ، وهي المقاصد من وراء تبني نظام التقاضي على درجة واحدة إلكترونيا؟ ومدى إمكانية تطبيق هذا النظام في الكويت عن طريق الاستعانة ببعض القوانين المُقارنة؟ وما هي الحلول المطروحة لجعل هذه الفكرة ممكنة للتطبيق؟ ، وما أوجه الضمانات لكفالة حق الأفراد وتحقيق الغاية المرجوة من هذا النظام ؟
ومن خلال بحثنا في هذا الموضوع توصلنا لجملة من والنتائج والتوصيات نجيزها فيما يلي :
النتائج: ظاهرة البطء في إجراءات التقاضي ظاهرة يعاني منها القضاء الكويتي بشكل كبير، لا يوجد في الكويت نظام يسهل ويبسط عمل القاضي مثل ما هو معمول بالقوانين المقارنة من قاضي تحضير، لم يواكب القضاء الكويتي التطورات الإلكترونية في القضاء وما له من آثار إيجابية، عزوف عن اللجوء للقضاء لحل المنازعات وذلك لبطء في حل النزاع ولما له من تأثير على الحصول على الحق بشكل سريع.
التوصيات: استحداث نظام تشريعي متكامل ملائم لوضع التقاضي على درجة واحدة ووضع الحلول التشريعية المناسبة لهذا النظام، تخصيص القضاة بشكل ادق من خلال دورات تدريبية مخصصة لكل قاضي وتخصصه، تبني نظام قاضي التحضير بشكل يساعد القاضي وجعل صميم تخصصاته إدارية وتجهيز الدعوى، تحويل نظام التقاضي إلى الكتروني وسن تشريعات تسد الثغرات القانونية وتمكن من تطبيقه بشكل فعال، تثقيف كل من يخاطبه أو يعمل بالقانون بما يصدر منه من انظمه مستحدثة ومساعدتهم على كيفية التعامل وتطبيق هذا النظام.

Complete justice for litigation, practical suggestions

Abstract:
    The research presents an integrated system that may contribute to the effective development of the judiciary, in which litigation is electronic and at one level, consisting of specialized judges in addition to a preparatory judge, as this system aims primarily to facilitate litigation, and achieve complete justice through speed in fulfilling the right, in order to avoid slowness. In litigation, however, this system has economic benefits that attract investment and enhance individuals’ confidence in resorting to the judiciary, as this system creates greater confidence and speed. Therefore, it is suggested to the Kuwaiti legislator to keep pace with developments by developing an integrated law that adopts this system.
Based on the above, the researcher poses several questions in order to reach practical solutions to them. What are the objectives behind adopting a single-degree electronic litigation system? To what extent is it possible to implement this system in Kuwait by using some comparative laws? What solutions are proposed to make this idea possible for implementation? What are the guarantees to guarantee the rights of individuals and achieve the desired goal of this system?
Through our research into this topic, we arrived at a number of results and recommendations, which we summarize as follows:
Results: The phenomenon of slowness in litigation procedures is a phenomenon from which the Kuwaiti judiciary suffers greatly. There is no system in Kuwait that facilitates and simplifies the work of the judge, such as what is done in comparative laws of preparing a judge. The Kuwaiti judiciary has not kept pace with electronic developments in the judiciary and its positive effects. A reluctance to Resorting to the judiciary to resolve disputes is due to the slowness in resolving the dispute and its impact on obtaining the right quickly.
Recommendations: Developing an integrated legislative system suitable for placing litigation on one level and developing appropriate legislative solutions for this system, allocating judges more precisely through training courses dedicated to each judge and his specialization, adopting a judge preparation system in a way that helps the judge and making the core of his specializations administrative and preparing the case, converting the litigation system to Electronically, enacting legislation that fills legal gaps and enabling it to be applied effectively, educating everyone who addresses it or works with the law about the new systems it issues and helping them on how to deal with and apply this system.
