تحقيق المناط بالحقائق العلمية، دراسة تأصيلية تطبيقية

ملخص البحث:
    إن علم أصول الفقه علم عظيم نفعه، بيّن شرفه وقدره، إذ هو قاعدة الأحكام الشرعية، وأساس الفتاوى الفرعية، وقد اعتنى به العلماء فألفوا فيه في كل عصر مؤلفات تناسب عصرهم ومعطياته، وما زالوا يؤلفون وكل منهم يبذل جهده ويتحرى ما وسعه التحري في سبيل تقريب هذا العلم، وتوضيحه، وتنزيله على أرض الواقع. ومما لا يخفى أن النهضة العلمية المعاصرة، كشفت لنا عن كثير من الحقائق العلمية التي لم يعرفها العلماء السابقون، وهذه الثورة العلمية في شتى المجالات ينبغي أن ترافقها جهود الباحثين الشرعيين، تأصيلاً لهذه الحقائق العلمية، وتوجيهاً لكيفية الاستفادة منها في الأحكام الاجتهادية، كالاستعانة بها في تحقيق المناط، ومن هنا كان هذا البحث بعنوان: (تحقيق المناط بالحقائق العلمية - دراسة تأصيلية تطبيقية). تناولت فيه تعريف تحقيق المناط، وحجيته، ومسالكه التي قررها علماء الأصول، ثم تعريف الحقائق العلمية وبيان المراد بها، ثم حكم الاستعانة بالحقائق العلمية في تحقيق المناط للتوصل إلى الحكم الشرعي في بعض المسائل الفقهية. وقد اتبعت في هذا البحث المنهج الاستقرائي، والاستنباطي، وانتظم البحث في مقدمة، وثلاثة مباحث، وخاتمة، بينت فيها أهم نتائج هذا البحث ومن أهمها أن الحقائق العلمية يمكن أن تكون مسلكاً من مسالك تحقيق المناط؛ لأنها ترجع إلى العقل والحس، أو إلى الحس وطبيعة الأشياء، وقد ثبت بالاستقراء أن العلماء لا يزالون يقلدون أهل الخبرة والمعرفة في هذه الأمور ممن ليسوا بفقهاء.

(Investigation of scientific facts - an applied fundamental study)

Abstract:
Indeed, the science of Fundamentals of  jurisprudenceis is a great discipline that has significant benefits. Its honor and value are evident as it forms the basis for legal rulings and the foundation for subsidiary legal opinions. Scholars have devoted significant attention to Fundamentals of jurisprudence throughout history, producing works that are suitable for their respective eras and circumstances. They continue to author new works, with each scholar exerting their efforts and striving to explore this field to the best of their abilities. Their aim is to make this knowledge more accessible, clarify its concepts, and apply it in practical contexts. It is undeniable that the modern scientific renaissance and technology has revealed many scientific truths that were unknown to earlier scholars. This scientific revolution across various fields should be accompanied by the efforts of jurists and legal researchers to establish a solid foundation for incorporating these scientific truths and directing how to benefit from them in juristic rulings. One way is by utilizing these truths in investigating general rule (legal objectives and purposes) in Islamic jurisprudence. Hence, the title of this research is "Investigating general rule with Scientific truths: An Applied Theoretical Study on Some Jurisprudential Issues."
This research follows an inductive and deductive methodology. It is structured with an introduction, three sections, and a conclusion. The first section clarifies the meaning of investigating general rule (legal objectives and purposes). The second section explains the concept of scientific truth and the ruling on utilizing them in investigating general rule. The third section focuses on applying the investigation of general rule with scientific truth to some jurisprudential issues.
