ملخص البحث:
في هذا البحث الموسوم بـــــ: "التخلف العقلي، وأثره في أهلية المكلف" بيان لحال فئة من ذوي الاحتياجات الخاصة؛ ممن ابتلاهم الله تعالى بضعف في القدرات العقلية من جهة أثره على التكليف الشرعي. فتطرق البحث لتعريف التكليف وشروطه، والتفصيل في ذكر أهلية المكلف، وبيان عوارض الأهلية. ثم بيان المقصود بالتخلف العقلي من النواحي الطبية، والسلوكية، والإحصائية، والتربوية، وذكر أنواعه ودرجاته. وبيان أثر التخلف العقلي على أهلية المكلف. ومن نتائجه: أن المفهوم الصحيح لتشخيص التخلف العقلي يكون بمراعاة جميع الأبعاد الطبية والنفسية والاجتماعية والتربوية ومقياس الذكاء، دون الاعتماد على بعد واحد. وأن المتخلف العقلي البسيط وفق ما ذكر في تعريفه وخصائصه يأخذ حكم الصبي المميز في جميع الأحكام، أما المتخلف العقلي المتوسط والشديد فيأخذ أحكام المجنون. ومن توصيات البحث. دراسة عوارض الأهلية دراسة تجديدية تجمع بين أقوال الأصوليين والفقهاء المدونة في كتبهم وأقوال أهل الاختصاص في العلوم الحديثة المتعلقة بتلك العوارض. مصطلح العته بحاجة إلى دراسة مستقلة تتبع معانيه عند الفقهاء والأصوليين، وأقوال العلماء في التخصصات الحديثة، وبيان أثره في التكليف. دراسة الأهلية وعوارضها المذكورة في الكتب الأصولية الحنفية من خلال كتب الجمهور الأصولية والفقهية.

Mental retardation and its impact on
 the eligibility of the taxpayer

Abstract:
In this research entitled: “Mental retardation and its impact on the eligibility of the taxpayer,” an explanation of the situation of a group of people with special needs; Among those whom God Almighty has tested with weakness in their mental abilities in terms of legal obligations. The research addressed the definition of the assignment and its conditions, detailing the eligibility of the assignee, and explaining the symptoms of eligibility. Then explain what is meant by mental retardation from the medical, behavioral, statistical, and educational aspects, and mention its types and degrees. Explaining the impact of mental retardation on the taxpayer’s eligibility.
Among its results: The correct concept for diagnosing mental retardation is by taking into account all the medical, psychological, social, educational, and intelligence dimensions, without relying on a single dimension. The mildly mentally retarded person, according to his definition and characteristics mentioned above, takes the ruling of a distinguished boy in all rulings, while the moderately and severely mentally retarded person takes the rulings of an insane person.
Among the research recommendations. Studying the symptoms of eligibility is a renewed study that combines the sayings of the fundamentalists and jurists recorded in their books and the sayings of specialists in modern science related to those symptoms. The term dementia needs an independent study that follows its meanings according to jurists and fundamentalists, the sayings of scholars in modern disciplines, and an explanation of its impact on assignment. Studying eligibility and its symptoms mentioned in Hanafi fundamentalist books through the majority of fundamentalist and jurisprudential books.
