ملخص البحث:
لقد اهتمت الدول على كافة المستويات الدولية والوطنية بحماية حقوق ذوي الاحتياجات الخاصة، فأصدرت العديد من الاتفاقيات، والأنظمة والقوانين الوطنية، والتي جاءت بضمان حماية حقوق المعوقين، وهذا ما دعا إلى تناول هذه الحماية الدولية لحقوق الأشخاص ذوي الإعاقة بالبحث والدراسة، وبيان ماهية الإعاقة وأسبابها والتطور التاريخي لحقوق المعاقين، كما تهدف الدراسة إلى إبراز التزامات الدول تجاه حقوق المعاقين، ومدى قيام المسؤولية الدولية في حال الإخلال بهذه الالتزامات، ومقارنة ذلك بالفقه الإسلامي، وقد استنتج الباحث إلى إبراز أوجه الحماية الدولية لحقوق الأشخاص ذوي الإعاقة، ومشروعيتها في ضوء القانون الدولي والوطني، ولأهمية هذه الحقوق فإن الباحث يقترح إنشاء منظمة عالمية تدعم هذه الحقوق، كما يوصي بإنشاء مراكز ومؤسسات وطنية تعزز هذه الحماية وتساعد في نشر الوعي بثقافة حقوق ذوي الاحتياجات الخاصة.

Abstract
Countries at all national and international levels have taken care of protecting the rights of people with special needs. They have issued many national agreements, regulations and laws, which came to ensure the protection of the rights of people with disabilities.
This led to international protection of the rights of persons with disabilities to be researched and studied, and to indicate the nature of disability, its causes and the historical development of the rights of persons with disabilities. The study also aims to highlight the obligations of states towards the rights of persons with disabilities. The extent to which international responsibility is established in the case of a breach of these obligations, and to compare that with Islamic jurisprudence. The researcher concluded to highlight the aspects of international protection for the rights of persons with disabilities,
Their legitimacy in the light of international and national law, and because of the importance of these rights, the researcher suggests the establishment of an international organization that supports these rights.
