مفهوم حقوق الطفل: رؤية تتجاوز مفهوم الضعف والحاجة إلى الحماية

ملخص البحث:
   منذ أكثر من ثلاثين عامًا تم تطبيق (اتفاقية الأمم المتحدة لحقوق الطفل)، وصدرت عن الجمعية العامة للأمم المتحدة عام 1989م، ومنذ ذلك الحين أصبحت المعاهدة الدولية لحقوق الإنسان الأكثر إقرارًا كل عام. ولكن مع انتشار قراراتها المختلفة، ظهرت مجموعة من القضايا العملية والمفاهيمية والأخلاقية. على سبيل المثال، طُرحت أسئلة تتعلق بقدرة الأطفال وكفاءتهم لاتخاذ قرارات مستقلة في الكثير من القضايا المختلفة، كما ظهر الجدال حول إقحام الأطفال في حل النزاعات والمدى الذي يجب أن ترتبط فيه الحقوق بالإنصاف لجعلها ذات جدوى.  وتظل العلاقة بين حقوق الأطفال من جانب وحقوق والديهم من جانب آخر سببًا في التوترات في نواح، مثل قانون الأسرة والتعليم. كما تظهر تحديات خاصة فيما يتعلق بحقوق الأطفال الأصغر سنَا والأطفال ذوي الإعاقة، إذ إن هذه القضايا تجذب الانتباه على الصعيدين المحلي والدولي.
   إن مثل هذه القضايا تثير عدة تساؤلات، مثل ما هي العلاقة بين مفهوم ضعف الأطفال وحقوق الطفل؟ للإجابة على هذا التساؤل، هناك حاجة إلى توسيع مفهوم (الأطفال) بطريقة تعترف بقدراتهم المتطورة وحقهم في المشاركة الحياتية.

Concept of Vulnerability and the Need for Protection

Abstract
   More than thirty years ago, the United Nations Convention on the Rights of the Child was implemented, and it was issued by the United Nations General Assembly in 1989 AD, and since then it has become the most recognized international human rights treaty every year. But as its various decisions spread, a host of practical, conceptual, and ethical issues emerged. For example, questions have been raised regarding children's ability and competence to make independent decisions in many different cases, and arguments have arisen about the involvement of children in conflict resolution and the extent to which rights must be linked to equity to make them meaningful. The relationship between the rights of children on the one hand and the rights of their parents on the other remains a source of tensions in areas such as family law and education. Particular challenges also arise with regard to the rights of younger children and children with disabilities, as these issues attract attention both domestically and internationally.
   Such issues raise several questions, such as what is the relationship between the concept of child vulnerability and children's right? In order to answer this question, there is a need to broaden the concept of “children” in a way that recognizes their evolving capacities and their right to participate in life.
