تنفيذ عقوبة القتل بغير السيف دراسة فقهية مقارنة بالنظام السعودي

الملخص : 
     جاءت الشريعة بتحقيق العدل بين الناس، ونشر الأمن بينهم، وتنوعت وسائلها في ذلك، فكان القتل إحدى هذه الوسائل وأعظمها، فشرعه الله تعالى في القصاص وغيره، وجعل في ذلك حياةً للناس فقال: ﴿وَلَكُمْ فِي الْقِصَاصِ حَيَاةٌ﴾، فبه يمتنع الناس من قتل بعض، فيحيون بذلك.
     وقد تناولت في هذا البحث الموسوم بـ(تنفيذ عقوبة القتل بغير السيف دراسة فقهية مقارنة بالنظام السعودي) عدداً من وسائل تنفيذ عقوبة القتل في العصر الحديث، ومقارنتها بالنظام السعودي، واستثنيت في عنوان البحث القتل بالسيف؛ لأنها وسيلة التنفيذ التي جاءت بها النصوص الشرعية كما سيأتي في البحث، استهللت البحث بالحكمة من مشروعية القتل، وضوابط آلة القتل في الشريعة الإسلامية، ثم عرجت على مسألة القتل بالمثل في الفقه والنظام السعودي، ثم تناولت بالبحث عدداً من أشهر وسائل القتل المعاصرة كالحقنة المميتة، والكرسي الكهربائي، والرمي بالرصاص، عرضت في جميع المسائل أقوال الفقهاء وأدلتهم، والخلاف الفقهي إن وجد، ثم ثنيت بمبحث يتناول المسألة في النظام السعودي، وختمت البحث بخاتمة تضمنت أبرز النتائج.

Abstract :
     Sharia law came to achieve justice among people and spread security among them, and its means for doing so varied. Murder was one of these means and the greatest of them. So God Almighty legislated it in retaliation and other things, and made it in that.
As a life for the people, he said: “And for you there is life in retaliation.” Thus, people are prevented from killing each other, and thus they live.     In this research entitled (Implementing the death penalty by means of a sword other than the sword, a jurisprudential study compared to the Saudi system), I have discussed a number of means of implementing the death penalty in the modern era, comparing it to the Saudi system, and I excluded in the title of the research murder by the sword. Because it is the means of implementation provided by the legal texts, as will be mentioned in the research. I began the research with the wisdom behind the legality of killing.
And the controls of the killing machine in Islamic law, then I touched on the issue of murder by the same in Saudi jurisprudence and the system, then I discussed in research a number of the most famous contemporary means of killing, such as lethal injection, the electric chair, and firing squad. I presented on all issues the sayings of the jurists and their evidence, and the jurisprudential disagreement, if any, then I included a study that addresses the issue in the Saudi system, and I concluded the research with a conclusion that included the most prominent results.
