ملخص البحث
الحمد لله الذي يسّر لي كتابة هذا البحث بعنوان "دراسة وتحقيق شهادة النساء مع الرجال والشهادة على الشهادة وكتاب القاضي إلى القاضي من كتاب شرح الجامع الصغير لظهير الدين التُمُرْتَاشِيّ المتوفي 610هـ"، وقد تناول البحث قسمين: القسم الأول: قسم الدراسة: واشتمل على التعريف بالمؤلّف ومؤلفه، وقد تناولتْ ترجمتُه: اسمه، وأسرته، ونبذة عنه، وشيوخه، وتلاميذه، وآثاره العلمية، ثم وفاته، وثناء العلماء عليه. وكتابه شرح الجامع الصغير: تناولتُ فيه الباعث على تأليف الكتاب. ومنهج المؤلف في الكتاب، وأهمية الكتاب ومزاياه، والقسم الثاني: قسم التحقيق، وهو في شهادة النساء مع الرجال، والشهادة على الشهادة، وكتاب القاضي إلى القاضي، واشتمل على حكم شهادة النساء مع الرجال، والشهادة على الشهادة، وكتاب القاضي إلى القاضي، ومتى تجوز الشهادة على الشهادة، ومتى يمتنع عن الشهادة، والأعذار المجوزة للتوكيل، ومتى تجوز شهادة الفرع، وصورة الإشهاد، وكيفية الضمان، ومتى يسأل القاضي عن الشهود، وشروط المزكي، كما تناول حكم الشهادة في مسائل جزئية عديدة متناثرة في الباب وما يترتب عليها.
وقد ظهر من خلال هذا البحث أهمية هذا الكتاب العلمية في الفقه الإسلامي عامة، وفي المذهب الحنفي خاصة من حيث إن متنه أحد كتب ظاهر الرواية المعتمدة في الفقه الحنفي.

Abstract:
            All praise is due to Allah Who facilitated to me the writing of this research entitled (A Study and Verification Endeavor of Book on (Testimony of Women with Men, Attestation of a Testimony , and a Judge’s Letter to a Judge) from the book of (Sharh Al-Jamie Al-Saghir)-Explanation of ‘Al-Jamie Al-Saghir , by: Thaheereddin Al-Tomrtashi (died 610H.). The research comprises two sections: Section One, The section of the study, which includes an introduction to the author and his book. His biography covers his name, family, and a brief summary of him and his senior scholars and disciples, in addition to his scientific impacts, his death, and the scholars' praise on him. In this book (Sharh Al-Jamie Al-Saghir), I dealt with his motivation for writing this book, the author's approach, and the significance of this book and its merits. Section Two is the section of verification of the testimony of women with men, attestation of a testimony, and a judge’s letter to a judge. It also addresses the ruling on the testimony of women with men, attestation of a testimony, and a judge’s letter to a judge, in addition to when it is permissible to attest a testimony, when one abstains from giving a testimony, what are the permissible excuses for appointing a procurator , and when the testimony of a descendant is permissible, with providing forms of attestation.The ruling covers, as well, methods of guarantees, when can the judge ask for witnesses, what are the conditions of an attesting person, in addition to the ruling of a testimony on many, partial, and scattered issues mentioned in the Book and the resulting issues of them.
            During conducting this research, there appears the scientific significance of this book in Islamic Jurisprudence (Fiqh), in general, and in the Hanafi school of Fiqh, in particular, since its text is one of the apparently approved narrations in Hanafi school of Fiqh.
