ملخص البحث
ينهض هذا البحث بتحقيق ودراسة مخطوط بعنوان (الفرض المسْتبين في الواجب على المسلمين)، وهو من تأليف الشيخ العلامة الفقيه أحمد بن محمد بن سليمان شهاب الدين أبي العباس الزاهد القاهري المحلي الشافعي المعروف بالزاهد (المتوفى سنة 819هـ). ويهدف التحقيق إلى التعريف بالعلامة الفقيه أحمد بن محمد بن سليمان المحلي الشافعي صاحب هذا المخطوط، والاطلاع على شيء من إرثه العلميِّ، والتعريف بالموجود منه والمفقود، وتحقيق مخطوطه الموسوم بـ (الفرض المسْتبين في الواجب على المسلمين) وإخراجه كما يريده مؤلفه. وقد اعتمدت نسخة مكتبة حاجي محمود أفندي بتركيا برقم: 1122، وسميتها (ح)، وسوف أقابلها بنسخة مكتبة عاطف أفندي ضمن مجموع برقم: 606، من: 34 ب -36 ب، هادفةً إلى إظهار النص كما يريده المؤلف. وقد توصّل البحثُ إلى جملة من النتائج؛ أبرزها: أن المخطوط بين أن هناك فروضًا لازمة واجبة على الرجال والنساء، أولها: الإيمان بالله تعالى وملائكته وكتبه ورسله، وأن للإيمان قواعد ثمانية، وللإسلام قواعد خمس، وأن هنالك واجبات؛ منها: الاستنجاء من النجاسات، والوضوء والغسل، والصلاة واجبة ولها فروض ومبطلات، وصوم رمضان واجب، والزكاة، والحج والعمرة واجبان مرة في العمر، وكان ذكره للأحكام وفقاً للمذهب الشافعي؛ باعتباره مذهبه، وأنهى كلامه بتوجيه المسلمين إلى وجوب الإيمان بسائر الأنبياء السابقين وبجميع كتبهم.
Abstract:
This research is based on the investigation and study of a manuscript entitled (The clear obligation in the obligation upon Muslims), which was written by the Sheikh, the scholar and jurist: Ahmad bin Muhammad bin Sulaiman Shihab al-Din Abi al-Abbas, the local Cairo ascetic, al-Shafi’i, known as the ascetic, who died in the year: 819 AH. The investigation aims to introduce the scholar and jurist: Ahmad bin Muhammad bin Suleiman Al-Mahli Al-Shafi’i, the author of this manuscript, and to learn about some of his scientific legacy, to introduce what is present and what is missing, and to verify his manuscript labeled “The clear obligation in the obligation upon Muslims” and produce it as its author intended I adopted the Haji Mahmoud Effendi Library copy in Turkey, No.: 1122, and named it (H), I will compare it with a copy of the library of Atef Effendi Library within a collection numbered: 606, from: 34 B - 36 B, aiming to show the text as the author wants it. The research reached a number of results, the most prominent of which is that the manuscript showed that there are obligatory duties for men and women, the first of which is belief in God Almighty, His angels, His books, and His messengers, and that faith has eight foundations, and Islam has five foundations, and that there are duties. Among them: cleaning oneself from impurities, ablution and ritual washing, prayer is obligatory and has obligations and nullifiers, fasting Ramadan is obligatory, zakat, Hajj and Umrah are obligatory once in a lifetime, and his mention of the rulings was in accordance with the Shafi’i school of thought, considering it his school of thought, and he ended his speech by directing Muslims to the obligation of believing in all the previous prophets and in all their books.
