التيسير في الفقه الإسلامي أسبابه وضوابطه

ملخص البحث
يقوم هذا البحث على مبدأ من المبادئ العامة في الشريعة الإسلامية وأصل من الأصول التي تقوم عليها الشريعة الخاتمة وهو مبدأ التيسير، وقد تناولت في الفصل الأول من هذا البحث التعريف بالتيسير كمبدأ من مبادئ الشريعة الإسلامية، وبينت أدلة مشروعيته من الكتاب والسنة . وفي الفصل الثاني من البحث تناولت الظروف والأحوال التي تعتري المكلف وتكون سببا في التخفيف والتيسير، وبينت أن أسباب التيسير في الشريعة الإسلامية غير محصورة وأنها تدور حول المشقة، والمشقة تختلف باختلاف الأحوال والأشخاص والأزمنة والأمكنة. وقد اكتفيت بذكر أهم هذه الأسباب وهي: السفر والمرض والنسيان والجهل والإكراه والخطأ. فتناولت السفر بالتعريف، وبينت مدة السفر، وشروطه، والأحكام التي تتغير بالسفر. ثم عرفت المرض، وبينت الأحكام التي تترتب على المرض. ثم بينت ماهية النسيان، وحكمه، وضوابطه، والأثر المترتب عليه.
ثم تناولت الجهل بالتعريف، وبينت حكمه، وأنواعه. ثم تناولت بالتعريف الإكراه، وبينت أنواعه، وأثره على التصرفات. ثم تناولت الخطأ بالتعريف، وبينت أنواعه. كما تناولت ضوابط التيسير في الشريعة وأجملتها في ثلاثة ضوابط
الضابط الأول: أن يستد التيسير إلى نص من الكتاب والسنة.
الضابط الثاني: عدم مجاوزة النص.
الضابط الثالث: ألا يعارض التيسير نصا شرعيا.
وذيلت البحث بخاتمة ضمنتها أهم النتائج والتوصيات التي أسفر عنها البحث، ثم فهرس للمصادر والمراجع.
Abstract:
based on one of the general principles in Islamic law and one of the principles upon which the final law is based, which is the principle of facilitation.
In the first chapter of this research, I discussed the definition of facilitation as a principle of Islamic law, and showed evidence of its legitimacy from the Qur’an and Sunnah.
In the second chapter of the research, I dealt with the circumstances and conditions that befall the taxpayer and that are a reason for mitigation and facilitation, and I showed that the reasons for facilitation in Islamic law are not limited and that they revolve around hardship, and hardship varies according to circumstances, people, times and places.
I have limited myself to mentioning the most important of these reasons: travel, illness, forgetfulness, ignorance, coercion, and error.
It dealt with travel by definition, and explained the duration of travel, its conditions, and the provisions that change with travel.
Then I defined the disease, and explained the rulings that result from the disease.
Then I explained the nature of forgetfulness, its ruling, its controls, and its impact.
Then I discussed ignorance by definition, and explained its ruling and types.
Then I discussed the definition of coercion, explained its types, and its effect on behavior.
Then I discussed the error by definition, and explained its types.
It also discussed the controls of facilitation in Sharia law and summarized them in three controls
The first condition: That the facilitation be based on a text from the Qur’an and Sunnah.
The second rule: Do not go beyond the text.
The third condition: The facilitation should not contradict a legal text.
The research was concluded with a conclusion that included the most important results and recommendations that resulted from the research,
then an index of sources and references.
