تكرار ألفاظ الطلاق وصوره على المشهور من مذهب الحنابلة

ملخص البحث
يحتوي هذا البحث على توطئة تشمل تعريف الطلاق لغة وشرعًا، وماهية (التكرار)، ثم التعريج على منهجية معرفة الراجح في المذهب الحنبلي والمشهور منه، وقد قسمت الدراسة إلى ثلاثة مباحث، وخاتمة؛ اشتمل المبحث الأول على مسائل تكرار الطلاق بصريح العدد أو بما يحتمله، أو بما يصف الطلاق بما يقتضي البينونة، وتناول المبحث الثاني تكرار لفظ الطلاق، إمَّا بتكرار الجملة من المبتدأ والخبر بدون حرف العطف، وإما بتكرار الخبر دون المبتدأ، وإما بتكرار الخبر فقط، وإما بتكرار الجملة مع أحد حروف العطف، تلا ذلك المبحث الثالث، وقد اختص بمسائل تكرار لفظ الطلاق المعلَّق، إما بتكرار تعليق لفظ الطلاق دون لفظ التعليق، وإما تكرار لفظ الطلاق مع تكرار لفظ التعليق، وفي الخاتمة توصيات لأهل الفتوى بأهمية ضرورة البحث في نية من صدر منه الطلاق ، وضرورة البحث فيما يستجد من مسائل مستحدثة في صور تكرار الطلاق في العصر الحاضر.
Abstract:
This research includes an introduction that includes the definition of divorce in language and Sharia, and the nature of (repetition), then a detour to the methodology of knowing the most correct and famous opinion in the Hanbali school of thought. The study was divided into three sections and a conclusion. The first section included issues of repeating divorce with an explicit number or with what it implies, or with what describes divorce in a way that requires separation. The second section dealt with repeating the word divorce, either by repeating the sentence of the subject and predicate without the conjunction, or by repeating the predicate without the subject, or by repeating the predicate only, or by repeating the sentence with one of the conjunctions. This was followed by the third section, which was specialized in issues of repeating the word of conditional divorce, either by repeating the suspension of the word of divorce without the word of suspension, or repeating the word of divorce with the repetition of the word of suspension. In the conclusion, there are recommendations for those who issue fatwas on the importance of the necessity of researching the intention of the one who issued the divorce, and the necessity of researching the emerging issues in the forms of repeating divorce in the present era.
