ملخص البحث
لقد صارت الخطابات محور عدد من الدراسات التي اهتمت بدراسة كافة أنواع الخطابات من سياسية وإعلامية وأدبية وقانونية وغيرها، والسبب في ذلك يرجع لأهميتها وارتباط المُجتمعات بها؛ مما يعكس صور التفاعل بين أفرادها، ويحتل الخطاب القانوني جانباً مهماً في حياة الشعوب، لا سيما وأن سيادة القانون من أساس ديمقراطية الدول، فالخطاب القانوني عملية اتصاليّة متكاملة تبدأ من منتج الخطاب القانوني، الذي ينطلق من فكر أو وجهة نظر أو عقيدة معينة، ويعتمد في ذلك على صياغة الخطاب الاتصالي، أيّ الرسالة بأسلوب محكم من ناحية الشكل والمضمون معتمدًا على أساليب الاقناع والتأثير، واختيار الرموز اللفظية والعلاماتيّة المتنوعة والأشكال والقوالب الفنية عبر وسائل الاتصال التقليديّة، سواء أكان بالمحكمة أو غيرها من الجهات والهيئات القضائية، أو حتى أمام وسائل التواصل التقني الحديثة المرتبطة بالشبكة المعلوماتية، لذلك استهدف البحث الحالي التعرف على مجموعة من المفاهيم لموضوع البحث، وتأثير التحليل للخطاب القانوني والنموذج موضوعه "جريمة قتل عمد"، وقد استخدم البحث الحالي كلاً من المنهج الوصفي التحليلي والمنهج اللساني البينوي والمنهج التاريخي لملائمتهم لتحليل الخطاب القانوني والنموذج به. وقد أوضحت الدراسة بالأنموذج أطراف دعوى الحق الخاص وأسانيد المدعي بالحق الخاص والرد عليها ومحاججتها من المدعى عليهما وكالة وكذا أسباب القضاء في الدعوى وذلك وفق منهجية بينوية تخص تحليل الخطابات القانونية. Abstract: Discourse has become the focus of several studies that have addressed various types of discourses, such as political, media, literary, legal, and others. The reason for this is its importance and its connection to societies, reflecting the interaction among their members. Legal discourse plays a crucial role in the lives of nations, especially since the rule of law is one of the foundations of democracy. Legal discourse is a comprehensive communicative process that begins with the creator of the legal discourse, who starts with a particular thought, perspective, or ideology. It relies on structuring the communicative discourse or message, using precise and coherent formulation in terms of both form and content, and relying on persuasion and influence techniques. It also involves the use of various verbal and semiotic symbols, as well as artistic forms and frameworks through traditional communication channels, whether in court or other judicial bodies, or even in the context of modern technological communication platforms connected to the information network.Therefore, the current research aims to explore a set of concepts related to the subject, the impact of analyzing legal discourse, and the case model titled "Intentional Murder." The research employed descriptive-analytical, semiotic, and historical methodologies due to their relevance in analyzing legal discourse and the model. The study clarified, using the model, the parties to the private right case, the plaintiff's legal arguments and their rebuttal, as well as the reasons for the court's decision in the case, based on a semiotic methodology for analyzing legal discourses.
