ملخص البحث :
تهدف هذه الدراسة إلى بيان صلاحية تراثنا الفقهي ليكون منطلقاً لأحكام تشريعية عصرية ومنضبطة محققة مصالح البلاد والعباد. تتناول الدراسة تعريف الذكاء الاصطناعي وحكم استخدامه من منظور الفقه الإسلامي.  تسلط الضوء على تقنية الذكاء الاصطناعي باعتبارها تقنية متطورة واسعة الانتشار، واعدة بمزيد من التطور، ومدى تفعيل تطبيقاتها على أرض الواقع، وتتناول الأحكام الفقهية المتعلقة باستخدام الذكاء الاصطناعي، والوقوف على الاختلافات الفقهية الواردة بهذا الشأن. وتتناول أهمية الذكاء الاصطناعي وضوابط استخدامه ، ومخاطره من منظور الفقه الإسلامي . توصلت الدراسة بأن للذكاء الاصطناعي دور فعال فى الميادين التى تتضمن تفاصيل كثيرة تتسم بالتعقيد، وتحتاج إلى مجهود عقلى، وتركيز ذهني متواصل، وقررات حاسمة وسريعة لا تحتمل الخطأ أو التأخير. توصى بالعمل على دراسة القضايا المختلفة للذكاء الاصطناعي في المجالات المتعددة، مع تأصيلها، وتخريج حكمها على المسائل الفقهية المذكورة في كتب الفقه القديمة.
Abstract:
This study aims to demonstrate the capacity and relevance of our Islamic jurisprudential heritage to serve as a foundation for modern, disciplined legislative rulings that achieve the interests of both the nation and its people. The study addresses the definition of artificial intelligence and the rulings on its use from an Islamic jurisprudence perspective.
It highlights artificial intelligence as a highly advanced and a widespread adopted technology, promising further development, and assesses the extent of its real-world applications. It also explores the jurisprudential rulings related to the use of artificial intelligence and examines the jurisprudential differences in this regard.
The study also discusses the importance of artificial intelligence, the guidelines for its use, and its risks from an Islamic jurisprudential perspective. The study concludes that artificial intelligence plays an effective role in fields that involve numerous detailed and complex tasks, requiring mental effort, continuous focus, and decisive, quick decisions that tolerate no errors or delays. The study recommends further exploration of various artificial intelligence-related issues across different fields, anchoring them in Islamic legal principles and deriving rulings for them based on jurisprudential cases discussed in classical jurisprudence books.
