 يتوصل البحث إلى الاحتجاج بالقرعة في المذهب الحنبلي، مستشهداً باستعمالها في كتاب ©الصلاة® من كتب المذهب.
والمقصد من القرعة تمييز المستحق، وإعطاء الحق، ورفع الخلاف، وكيف استعملت القرعة جاز؛ لأن المقصود منها إثبات الحقوق، وهي تدخل في مسائل الأموال، والولايات والاختصاص، وفي مسائل الأبضاع، ووقع الخلاف في إثبات النسب بها. وذكر ابن رجب في قواعده قاعدة القرعة، وحصر المسائل الفقهية التي تدخلها، إلا أنه فاته شيء من المسائل التي استعملت فيها، وهذا ما تجده في البحث. وخلصت الدراسة إلى عدد من النتائج، منها: لا خلاف في المذهب في الاحتجاج بالقرعة، وهذا هو المنصوص عن الإمام من طرق متعددة؛ لثبوت النص فيه من القرآن والسنة. ضابط المصير إلى القرعة هو عند التساوي والمشاحة وعدم المرجح؛ ولأنها تميز المستحق سواء كان معيناً أم مبهماً. القول بالقرعة في المسائل غير المنصوصة عن الإمام أحمد  قياس المذهب. المسائل التي تدخلها القرعة على المذهب: تستعمل في مسائل الأموال، وإثبات حقوق الاختصاص والولايات، وتدخل في مسائل الأبضاع، وأما النسب فعلى المذهب أن القرعة لا تدخلها. المذهب في كيفية استعمال القرعة أنه كيفما استعملت جاز؛ لأن المقصود منها تمييز المستحق.
Abstract:
 The study affirms the validity of drawing lots in the Hanbali school, citing its use in the Book of Prayer. The purpose of drawing lots is to identify the rightful claimant, ensure justice, and resolve disputes. Its applications include matters of wealth, leadership, jurisdiction, and marital issues, though there is disagreement regarding its use in establishing lineage. Ibn Rajab discussed the principle of drawing lots in his Qawa’id and listed related jurisprudential cases, though some instances were overlooked, which this study addresses. The study concluded several findings, including: There is no disagreement in the school of thought regarding the use of lottery. This is what was stated by the Imam through multiple chains of transmission, as it is proven in the Qur’an and Sunnah. The criterion for resorting to lottery is in cases of equality, dispute, and lack of a superiority, and because it distinguishes the deserving party, whether he is specific or vague. The opinion of lottery in matters not stated by Imam Ahmad is analogical to the school of thought. Issues covered by lottery, according to the school of thought: It is used in matters of property, establishing rights of specialization and guardianship, and is also included in matters of merchandise. As for lineage, according to the school of thought, lottery is not included in these matters. The school of thought regarding the manner of using lottery is that it is permissible however it is used, because its purpose is to distinguish who is entitled to it.
