ملخص البحث :
يهدف هذا البحث إلى استقصاء المسائل التي بنى عليها فقهاء الحنفية أحكامهم استناداً إلى آثار الصحابة في كتاب النكاح والطلاق، مع بيان منهج الحنفية في التعامل مع أقوالهم، ووجه استدلالهم بها، وتحليل الخلافات داخل المذهب في تلك المسائل، وذلك لتحقيق فهمٍ أعمق لهذه القضايا، وتسليط الضوء على الأصول التي استندت إليها المدرسة الحنفية في صياغة فقهها. وتتضح أهمية هذا البحث من خلال إبراز منهجية الحنفية في الاستنباط ، وأهمية القضايا الأسرية في حياة المسلمين، وتأصيل العلاقة بين النصوص وآثار الصحابة، وسد الفجوة بين الماضي والحاضر .
وفي ختام البحث توصلت إلى بعض النتائج كان من أهمها : حرص الحنفية على الاقتداء بالصحابة ؛ ولذا قدموا أقوال الصحابة على القياس، وأن معظم آثار الصحابة تروى في كتب الحنفية بالمعنى، وكذلك ظهر لي أن بعض الآثار التي أوردها الحنفية أحاديث مروية عن الرسول وليست أقوالاً للصحابة . كما أوصيت في خاتمة البحث على ضرورة استمرار الباحثين في هذ النوع من البحوث لإبراز أهمية آثار الصحابة عند السلف الصالح وخاصة المذاهب المتبعة.
Abstract :
This research aims to investigate the issues upon which Hanafi jurists based their rulings based on the Companions' traditions in the Book of Marriage and Divorce. It also aims to clarify the Hanafi approach to dealing with their statements, the basis for their reasoning based on them, and to analyze the disagreements within the school regarding these issues. This is to achieve a deeper understanding of these issues and to shed light on the principles upon which the Hanafi school relied in formulating its jurisprudence. The importance of this research becomes clear through highlighting the Hanafi methodology in deduction, the importance of family issues in the lives of Muslims, establishing the relationship between texts and the effects of the Companions, and bridging the gap between the past and the present. At the end of the research, I reached some results, the most important of which were: the Hanafis’ keenness to follow the example of the Companions; therefore, they presented the sayings of the Companions over analogy, and that most of the effects of the Companions are narrated in Hanafi books by meaning, and it also appeared to me that some of the effects cited by the Hanafis are hadiths narrated from the Messenger and not sayings of the Companions. I also recommended at the end of the research the necessity for researchers to continue this type of research to highlight the importance of the effects of the Companions among the righteous predecessors, especially the followed schools of thought.
