حقوق الإنسان أثناء النزاعات المسلحة في الإسلام

يناقش هذا البحث في إطاره النظري -التأسيسي مدى افتقار مقررات الفكر الحقوقي الإنساني أثناء النزاعات المسلحة للانطلاق من الرؤية الإسلامية، ويعمد لبيان المبادئ المركزية التي تقوم عليها تلك الرؤية، كما يعرض لدوافع النزاع المسلح في الإسلام وغاياته وأخلاقياته الواجبة والضوابط الكبرى لهذا النزاع حال وقوعه الحتمي، ومن ثم يدرس هذا البحث في إطاره التطبيقي الإجراءات الضامنة لحقوق الإنسان أثناء النزاع المسلح في الرؤية الإسلامية عبر استعراض مظاهر هذه الضمانات الحقوقية وتأكيدها بعد ذلك بتطبيقات من واقع المقررات الحضارية الإسلامية المتمثلة في المدونة الإسلامية وتطبيقات العصور الثلاثة المفضلة لها، ويتوصل إلى كون الرؤية الحقوقية الإسلامية للنزاعات المسلحة قادرةٌ على تقديم نموذج حضاري يعالج أزمات العالم المعاصر.
Abstract:
This research, in its theoretical and foundational framework, explores the extent to which contemporary human rights discourses during armed conflicts lack grounding in the Islamic worldview. It seeks to articulate the central principles upon which that worldview is based, and examines the motives, objectives, and obligatory ethics of armed conflict in Islam, as well as the overarching constraints that govern such conflict when it inevitably occurs.
In its applied dimension, the study investigates the procedural guarantees of human rights during armed conflict within the Islamic perspective, by analyzing the manifestations of these rights-based safeguards and reinforcing them through historical applications derived from the Islamic civilizational tradition—specifically, from the foundational Islamic corpus and the practical models of the three favored eras. The study ultimately concludes that the Islamic human rights perspective on armed conflict is capable of offering a civilizational model that addresses the crises of the contemporary world.
