إن الممتلکات الثقافية تشکل رمزا وهوية وتاريخا، وتحتل مکانة هامة لدى الشعوب. والأضرار التي تلحق بممتلکات ثقافية يملکها شعب ما، تمس التراث الثقافي الذي تملکه
الإنسانية جمعاء، فکل شعب يسهم بنصيبه في الثقافة العالمية.
وتعتبر النزاعات المسلحة مصدر تهديد دائم للممتلکات الثقافية سواء بسبب تعرضها للتدمير أو الاتجار غير المشروع بها خلال فترات النزاعات المسلحة خاصة مع تطور الأسلحة المستخدمة. ونظرا لاقتناع المجتمع الدولي بصعوبة تعويض مثل هذه الممتلکات التي يمتد تاريخها لمئات بل آلاف السنوات؛ فقد قامت الدول بتبني عدد من الاتفاقيات الدولية للحفاظ على هذه الممتلکات إبان النزاعات المسلحة لعل أبرزها اتفاقية لاهاي لحماية الممتلکات الثقافية أثناء النزاعات المسلحة لعام 1954 وبروتوکوليها الإضافيين، البروتوکول الأول عام 1954، والبرتوکول الثاني عام 1999.
کما قامت الهيئات والمنظمات الدولية الحکومية وغير الحکومية بدور کبير للحفاظ على الممتلکات الثقافية سواء في فترات السلم أو النزاعات المسلحة کمنظمة الأمم المتحدة واليونسکو واللجنة الدولية للصليب الأحمر واللجنة الدولية للدرع الأزرق.
وقد تم إقرار المسئولية الدولية للدول عند الاعتداء على الممتلکات الثقافية بالسلب أو النهب أو التدمير أثناء النزاعات المسلحة، وأيضا تم إقرار المسئولية الجنائية الدولية الفردية عند الاعتداء على هذه الممتلکات، وذلک باعتبار الاعتداء على الممتلکات الثقافية إبان النزاعات المسلحة يعتبر جريمة دولية، وذلک بغرض الحفاظ على هذه الممتلکات الثقافية خلال فترات النزاعات المسلحة.
 
 
 
 
 
 
 
 
 
 
 
 
 
Abstract
 
Cultural property is a symbol, an identity and a history, and occupies an important place among peoples. Damaging cultural property which belongs to people affects the cultural heritage of all mankind, each contributing its share to global culture.
            Armed conflicts are considered as constant threat to cultural property, whether due to destruction or illicit trafficking during periods of armed conflict, especially with the development of weapons used. The international community has adopted a number of international conventions As the international community is convicted  that it is difficult to get back such property, which dates back to hundreds or even thousands of years for the preservation of such properties during armed conflicts, most notably is The Hague Convention for the Protection of Cultural Property in the Context of Armed Conflict of 1954 and its Additional Protocols, Protocol I of 1954, and the Second Protocol of 1999.
           Intergovernmental and non-governmental bodies and organizations have played a major role in preserving Cultural Property during peace and armed conflicts such as the United Nations, UNESCO, the International Committee of the Red Cross and the International Blue Shield.
          The international liability of States in the attack on cultural property has been classified as a crime of looting, looting or destruction during armed conflicts. International criminal responsibility for attacking these properties has also been classified as an attack against cultural property during armed conflict.
