إن هذا البحث يتناول أساس مسؤولية الناقل البحري حيث تعتبر من المواضيع الرئيسة في عقود النقل البحري. حيث  يعالج هذا البحث أساس مسؤولية الناقل البحري في ظل قانون التجارة البحرية الأردني و الاتفاقيات الدولية، في مبحثين يتناول المبحث الأول بيان أساس مسؤولية الناقل البحري في التشريع الأردني و مدى موائمتها مع الاتفاقيات الدولية أما المبحث الثاني فيتناول دعوى مسؤولية الناقل البحري في حالة حدوث نزاع ما بين الناقل و الشاحن أو المرسل إليه نتيجة حدوث ضرر للبضائع أو في حالة إخلال الناقل بأحد التزاماته من تسليم البضاعة في الميعاد المحدد و خالية من اية عيوب وفي حال الإخلال ما يترتب للشاحن من مقاضاة الناقل و رفع دعوى عليه.

This article considers the basis of Maritime Carrier liability. It is one of the most significant subject in maritime transportation contract. Certainly, if a damage occurred to the shipment, a dispute arises between the carrier or the owner and the ship owner. If the carrier was not the ship owner as Respondent, the third parties are the Prosecutor by shipper or consignee, policyholder or Insurer in Lawsuit raised driven by breaching of contract under the contract of carriage evidenced by the bill of lading. In order to cover all-important aspects of the subject. This article will be divided in two parts. Part 1 will talk about the basis of maritime carveries’ liability for goods according to Jordanian legislation and its alignment with international agreements, while part 2 is about the liability of the maritime carrier in Jordanian legislation.
