تعتبر القاعدة القانونية العامة المجردة  الملزمة الأداة الوحيدة التي تستخدمها السلطة في تنظيم سلوک الإفراد ولذلک يفترض فيها ان لا تأتي مخالفة لحقوقهم وحرياتهم التي کفلها الدستور والتي تصدر عن السلطة التشريعية صاحبة الاختصاص الأصيل کإحدى المؤسسات الدستورية التي تهدف لضمان حسن السياسة التشريعية،  وفي حالة تجاوز السلطة التشريعية لحدود اختصاصاتها الدستورية تخضع لرقابة السلطة القضائية من خلال القضاء الدستوري ولذا فإن محور عمل القاضي الدستوري هو الرقابة على أعمال المشرع، حمايةً لمبدأ سمو الدستور بما يحتويه هذا الأخير من حقوق وحريات للأفراد. ولکن وحماية لأعمال المشرع من النتائج التي قد تترتب على الأحکام الدستورية، فإن القانون دائماً يصدر مقترناً بقرينة الدستورية، هذه القرينة تعد أهم الضمانات التي تعزز الثقة لدى البرلمان المنبثق من الإرادة الشعبية، هذا من جهة. ومن جهة ثانية فأنها تشکل ضابطاً وأساساً لعمل القاضي الدستوري، ناهيک أنها تخفف العبء عن القاضي الدستوري، بحيث يلزم من يدعي عدم دستورية القانون أن يقدم المبررات التي يدحض من خلالها قرينة الدستورية، وإلا فإن القاضي الدستوري سيحکم بالدستورية، تجنباً للوقوع بالخطأ، لأنه من السهل تصحيح الخطأ في الحکم بالدستورية، لکنه من الصعوبة بمکان تصحيح الخطأ في الحکم بعدم الدستورية. ولهذا فإن قرينة الدستورية تلعب دوراً بارزاً في دعم البرلمان، واستقرار مؤسسة القضاء الدستوري ، وتعزيز الثقة بها، وتحقق التوازن بين المبدأ الديمقراطي والرقابة على دستورية القوانين.

Parliamentary self-censorship on the constitutionality of laws in the Kingdom of Bahrain

A binding legal rule is the only tool for regulating the behavior of individuals who are supposed not to constitute violations of their rights and freedoms guaranteed by the Constitution
The elimination of the constitutional is one of the institutions of constitutional aims to ensure proper legislative policy, and therefore the focus of the work of constitutional judges is to control the work of the legislature, to protect the Constitution, including the principle of His Highness the contents of the latter's rights and freedoms of individuals. But to protect the work of the legislature from the results that may result from the constitutional provisions, the law is always issued in conjunction with the constitutional presumption, this presumption is the most important safeguards that enhance the confidence of parliament, emanating from the popular will, on the one hand. On the other hand, they are an officer and as a basis for the work of constitutional judges, not to mention it eases the burden on the constitutional judge, so that the necessary constitutional law claims not to submit reasons that confound the constitutional presumption of which, otherwise, the judge will judge the constitutional constitutionalism, in order to avoid the occurrence of error, because it is easy to correct the error in the government constitutionalism, but it is difficult to correct the error in the ruling of unconstitutionality. Therefore, the constitutional presumption play a prominent role in support of the parliament, the stability of the constitutional institution of the judiciary, strengthening of confidence, and achieve a balance between the democratic principle and control of the constitutionality of laws.
