فهذا بحث عنوانه (مدى صحة ونفاذ بيع الفضولي) وهو يتعلق بممارسة شائعة في حياة الناس.
وعلى الرغم من أن بيع الفضولي يخالف طبيعة عقد البيع، إلا أنه کثيرًا ما يحصل في الواقع العملي، فالأب قد يبيع ملک ولده لا باعتباره نائبًا عنه؛ بل أصيلًا عن نفسه، والزوج قد يبيع ملک زوجته، والوارث قد يبيع عينًا في الترکة ولکنها ليست في حصته، والشريک قد يبيع کل العين الشائعة ولا يملک إلا حصته فيها، وکثيرًا ما يبيع الناس أموال الغائبين، فهذه کلها تعتبر من تطبيقات بيع الفضولي. فلذلک يعتبر بيع الفضولي من المواضيع ذات الأهمية الکبرى؛ نظرًا لما يترتب عليه من آثار تتعلق بالحياة العملية للمجتمع.
ويتکون البحث من مقدمة، وتمهيد، وخمسة مباحث، ثم الخاتمة، والفهارس.
أما المقدمة فقد اشتملت على (مقدمة البحث، وأهمية الموضوع، والدراسات السابقة، ومنهج البحث، وخطة البحث).
المبحث الأول: بيان الفارق بين بيع الفضولي وما يقاربه، ويتضمن ثلاثة مطالب:
المبحث الثاني: مکان بيع الفضولي من عقد البيع، ويتضمن أربعة مطالب:
المبحث الثالث: حکم بيع الفضولي من حيث الصحة والنفاذ، وفيه مسائل:
المبحث الرابع: الآثار الفقهية لتصرف الفضولي، وفيه ثلاث مسائل:
المبحث الخامس: مقارنة بين حکم بيع الفضولي في الفقه الإسلامي، وحکمه في القانون الوضعي.
الخاتمة وتتضمن أهم النتائج والتوصيات.

Abstract
This is a research entitled "The validity and effectiveness of the sale of the inquisitor" and it is related to a common practice in people's lives.
The topic has also gained special importance in the entry of banking in general, and Islamic in particular, in trying to take advantage of the provisions of the actions of the curious in the manufacture of new products traded within the scope of Islamic banking.
Although the sale of the inquisitive is contrary to the nature of the sales contract, it is often what happens in practice, the father may sell the king of his son not as a deputy; He only owns his share of it, and people often sell absentee money, all of which are considered to be inquisitive sales applications. The refore, the sale of the inquisitive is one of the most important topics, given its implications for the working life of the community.
,The research consists of an introduction, a preface, five investigations, then a conclusion, and indexes.

The fifth thesis: a comparison between the ruling on the sale of the inquisitive in Islamic jurisprudence and his ruling on positive law.
The conclusion contains the most important findings and recommendations.
