((نفقة علاج الزوجة على الزوج بين الوجوب وعدمه (دراسة فقهية مقارنة)))

تُعد النفقة من أهم الحقوق المالية التي يرتبها عقد الزواج للزوجة على زوجها، بيد أن جمهور الفقهاء لم يذكروا نفقة العلاج من بين الأمور التي تشملها النفقة؛ لذلك كان هذا البحث الذي أماط اللثام عن هذا الموضوع، وقد اشتمل هذا البحث على مقدمة، وتمهيد، وستة مباحث، وخاتمة. وقد استخدمت الباحثة المنهج الاستقرائي، والمنهج التحليلي، والمنهج الاستنباطي في البحث. وقد توصل البحث إلى مجموعة من النتائج، أهمها: وجوب نفقة العلاج والتطبيب في مال الزوج لزوجته. ووفقاً للراجح من أقوال الفقهاء فإن نفقة علاج الزوجة واجبة على الزوج، بضوابط أهمها: أن يكون الزوج موسراً بنفقة علاج زوجته، وأن يكون علاج الزوجة مشروعاً، وأن يكون العلاج بالنسبة للزوجة مما تدعو إليه ضرورة أو حاجة، وأن يكون العلاج مجدياً في مثل حالة الزوجة، وألا تكون نفقة علاج الزوجة مفوتة لنفقة أولى منها، كنفقة نفسه، أو نفقة قوام الزوجة من المطعم، والملبس، وألا يتكفل بنفقة علاج الزوجة متكفل آخر غير الزوج، فإذا وجد متكفل بها غيره، فلا تجب هذه النفقات على الزوج. إن نفقة علاج الزوجة - كما هو الحال في النفقة بصفة عامة – تقدر بقدر كفاية الزوجة من هذه النفقات حسب حالة الزوج المالية والمرجع في ذلك كله إلى العرف. كما أن نفقة ولادة الزوجة واجبة على زوجها، شريطة أن تكون هذه النفقة بالمعروف، وأن تكون الزوجة محتاجة إلى هذه النفقات لإتمام عملية الولادة، وألا تكون هناك جهة أخرى تكفل هذه النفقات، وأن يكون الزوج قادراً على دفعها، فإن تخلف شرط من هذه الشروط فلا تكون هذه النفقات واجبة على الزوج.
Abstract :
Maintenance is one of the most important financial rights that the marriage contract stipulates for the wife over her husband. However, the majority of jurists did not mention medical expenses among the matters covered by maintenance; therefore, this research has lifted the veil on this topic. This research includes an introduction, a preface, six chapters, and a conclusion. The researcher used the inductive, analytical, and deductive approaches in the research. The research reached a set of results, the most important of which is: the obligation of medical expenses and treatment from the husband’s money for his wife. According to the most correct opinion of jurists, the wife's medical expenses are obligatory on the husband, subject to certain conditions, the most important of which are: that the husband be able to afford his wife's medical expenses; that the wife's treatment be lawful; that the wife's treatment be necessary or needed; that the treatment be effective in a situation similar to the wife's; that the wife's medical expenses not deprive her of more important expenses, such as his own expenses or the expenses of the wife's maintenance, such as food and clothing; and that the wife's medical expenses not be borne by anyone other than the husband. If there is someone else to bear the expenses, then the husband is not obligated to bear them. The wife's medical expenses - as is the case with maintenance in general - are estimated according to the wife's sufficiency in these expenses, based on the husband's financial situation, and reference in all of this is to custom. The wife's childbirth expenses are also obligatory upon her husband, provided that these expenses are reasonable, that the wife needs these expenses to complete the childbirth process, that there is no other party that guarantees these expenses, and that the husband is able to pay them. If any of these conditions are not met, then these expenses are not obligatory upon the husband.
